Terms of Use – Ezytrad

Article 1: Purpose

These Terms of Use define the conditions under which Ezytrad (hereinafter "the provider") makes its online translation services available to users, as well as the conditions under which users access and use the services. Ezytrad provides official translations exclusively delivered by NAATI-accredited translators (National Accreditation Authority for Translators and Interpreters – Australia). All translations are produced individually and for official or administrative use according to Australian standards.

Article 2: Access to Services

The services offered by Ezytrad are accessible to any user with an internet connection. All related costs—hardware, software, internet access—are borne solely by the user. The user is fully responsible for the proper functioning of their equipment and internet access. Services operate 24/7, except in cases of scheduled maintenance, technical incidents, or force majeure.

Article 3: Nature of the Services – Custom Work

Translations delivered by Ezytrad constitute personalized, custom-made services, produced exclusively for the individual user based on the documents provided. Under French, EU, and Australian law: • A translation begins immediately after payment is confirmed. • It is non-reusable, non-transferable, and cannot be canceled once production has begun. • The right of withdrawal does not apply to personalized services (French Consumer Code – Article L221-28). Under the Australian Consumer Law (ACL) (Competition and Consumer Act 2010, Schedule 2), refunds are only applicable if: • the service was not provided with due care and skill (Section 60), • the service is not fit for purpose (Section 61), • the service was not supplied within a reasonable time (Section 62). The ACCC clearly states: "Consumers are not entitled to a refund simply because they changed their mind." — ACCC, Consumer Guarantees: Services Because Ezytrad provides customized NAATI-certified translations, no refunds are possible once the service has started or has been delivered.

Article 4: Delivery of Translations

Translations are delivered electronically to the email address provided by the user. Ezytrad cannot be held responsible for: • errors in the email address provided, • spam filtering by the user's mailbox, • delays caused by the user, • incomplete, incorrect, or illegible documents supplied by the user. A translation is considered delivered once it has been sent to the user.

Article 5: Intellectual Property

All content on the Ezytrad website—texts, structure, images, graphics, logos, and more—is protected by intellectual property laws and remains the exclusive property of the provider. Any reproduction, distribution, modification, or reuse without prior written permission is strictly prohibited.

Article 6: Liability

The provider cannot be held liable for: • direct or indirect damages resulting from use of the site, • website downtime or unavailability, • viruses, data loss, deletion, or hardware damage, • incorrect or misleading information submitted by the user. The user is solely responsible for the accuracy of the documents submitted for translation. Any errors or omissions in the source documents are outside Ezytrad's responsibility. Attempts to initiate fraudulent chargebacks or disputes for a fully delivered custom service may result in: • formal dispute responses submitted to the bank, • claims for losses under the Competition and Consumer Act 2010 (Australia), • debt recovery actions for associated costs.

Article 7: Personal Data Processing

Ezytrad processes personal data in compliance with the GDPR (EU Regulation 2016/679). All information provided is treated confidentially and solely for the execution of translation services. Users have the right to access, modify, and delete their data by contacting: hello@ezytrad.com Source documents may be shared with NAATI-accredited translators strictly for the purpose of fulfilling the translation task.

Article 8: Hyperlinks

The site may include links to external websites. Ezytrad assumes no responsibility for the content, reliability, or policies of third-party sites.

Article 9: Modifications to the TOU

The provider reserves the right to modify these Terms of Use at any time, without notice, to reflect changes to the website, regulations, or business operations.

Article 10: Acceptance of the Terms

Use of the website or submission of an order constitutes full and unreserved acceptance of these Terms of Use.

Article 11: Governing Law and Jurisdiction

These Terms of Use are governed by French law. Should a dispute arise that cannot be resolved amicably, the French courts shall have exclusive jurisdiction.
